After Henry died in NC without having made a will, Margaret was awarded custody of their three minor children: John, Daniel, and Elizabeth, in the February 1798 court. Daniel died as a teen while John and he were en route "from NC to AL" searching land for their mother and sisters. Since the family was recorded in TN between the NC and AL residences, it is likely this was actually during the trip to TN, or TN to AL.

In 1801 Margaret deeded 112 acres of the land Henry had inherited from his father (after his mother's death), selling it to George Foust. On 19 November 1814 her heirs George and Mary Sharp and John and Elizabeth Loy sold the remaining 12 acres of the land to George Foust "and wife." In 1806 Margaret bought land on Lost Creek in (then) Claiborne Co., TN from her son-in-law's brother Daniel Sharp. Witnesses to this sale were Henry Sharp (both George's father and brother were named Henry), James McNutt (whose wife Mary was George's sister), John Loy (Margaret's son) and a Jacob Sharp. When she sold the same land in October 1808 (then in Campbell Co.) to Henry Sharp, who had been witness to her purchase, the witnesses then were Michael Huffacre and Jacob Sharp. James McNutt and John Loy at that time were in Madison Co., Mississippi Territory [now AL] where they were in next household to each other in the January 1809 census. They had also purchased their land together on the same day, 30 January 1809, in consecutive order, implying they had gone to the land office together to make the purchase.

*Family tradition gives John and Mary (Hodges) Loy married in 1805 Central Springs, AL, which is now in Morgan Co., formerly Cotaco Co., AL. But that territory would have been Indian land, not open to settlers in 1805. Because of this, and that their eldest child was born in TN, and that John signed his mother's 1806 land purchase in TN, it seems more likely they would have married in TN.

**Elizabeth and Henry Edward Caley's divorce was decreed in the October 1821 Morgan Co., AL circuit court, but not "approved" into AL state Acts until 29 November 1821.

According to Linda (Wiley) Loy's account, John Henry Loy's sisters married George Sharp, a Kaley, and a Tillman in the South, related to Senator Tillman. Benjamin Ryan Tillman, who was one of several Senator Tillmans in that era, was from South Carolina, as were the Grahams of AL, who were related to the SC Tillmans. It is my theory that the "Tillman" was really meant for James B. Graham, second husband of Elizabeth. This is also probably why some records of early Effingham Co., IL Loys suggest John Henry Loy had three sisters, because of three spouses mentioned, even though records show he only had two sisters. It was just one sister had two marriages. For several years I had been searching for the "Kaley" surname, but found no marriage to an Elizabeth Loy. Then, one of Martin's son John's descendants sent me copies from "Know Your Relatives," though I already had copies of its pages years before. But despite having seen these pages many times, it wasn't until then I noticed one Loy marriage that Genevieve Peters listed that wasn't mentioned by genealogy in her book. This was Elizabeth LAY to Henry Edward Coley, married 26 September 1814. (Note this was on 72nd anniversary Martin Loy came to America.) Mrs. Peters listed this marriage along with others that had taken place in Alabama. I found the Lay-Coley marriage in Madison Co., AL. Since Coley sounds so much like Kaley, I thought it possible this was John Henry's sister. Then, I came across a divorce record while online: Alabama Acts-107-113, Nov-Dec 1821 which is at the site of the AL State Legislature Archives. It gives the "Acts of November 1821" which lists Elizabeth CALEY from Henry Edward CALEY, the original record being on pg. 111, from Morgan Co., AL records. (Do "Find" in your browser for "Caley" to find the listing easily.) In the Morgan Co. marriage records, two months after her divorce, is the marriage of Elizabeth Caley to James B. Graham on 17 January 1822.
